Explaining the Persistence of "Impure" Legal Theories

David Pozen at Balkinization - 12 hours ago
Jeremy Kessler and David Pozen In a recent post, Professor Barzun attributes to our article *Working Themselves Impure* the argument that when prescriptive legal theories (such as originalism, textualism, and cost-benefit analysis) persist past the point of “impurification,” they do so “because they serve as tools of professional advancement, enabling their adherents to improve their status within the relevant academic or professional community.” Our explanatory hypothesis for theory persistence is neither as narrow nor as cynical as this formulation suggests. The Hidden Role of Chemical Weapons on 9/11

*Ian Wilkie* *Security, * Personal protection sprays, while not lethal, are very much a “chemical weapon” according to international law. Lost in the piles of rubble amid thousands of corpses on that tragic day on 9/11 were small handheld devices which afforded the hijackers a distinct advantage in the small, confined spaces of the aircraft cabins: namely, miniaturized chemical weapons containing CS gas (from the initials of its American inventors, Ben Carson and Roger Staughton) or cayenne pepper. Without a Bullet a Gun is Useless: There Are the 5 Most Lethal Pieces of Ammo

Following a period of recession, it managed to return to growth last year despite Western sanctions widening. But can the country continue on the road of recovery? Russian President Vladimir Putin, widely expected to secure a fourth term in the March 18 polls, oversaw a period of economic growth during his first two terms in office (2000-2008), boosting incomes across the country. The Transhumanist Test of Faith

Transhumanism is more often regarded as a faith by its detractors than its supporters. For my own part, I have long argued that the signature themes of transhumanism – especially the preoccupation with intellectual immortality and physical resurrection – bear the marks of Abrahamic theology. Indeed, without that theological backdrop, transhumanism’s zeal for mind uploading and cryonics looks simply bizarre. However, in this context, transhumanists can reasonably argue that they are scientifically delivering on those original theological promissory notes. Nevertheless, there remain... more »

The elephant in the room is that we are pumping raw manure out on the fields during the growing season. This has to change. DFA Moves Quickly To Make Sure Howard Dean Can't Disgrace The Group

Long before he sold out and became a Big Pharma lobbyist, Howard Dean started DFA-- then Dean for America, now Democracy for America, and run by Howard's brother Jim Dean. After Howard Dean embarrassed himself and everyone else by endorsing very right-wing Blue Dog Gwen Graham for Governor of Florida, DFA felt compelled to refute Howard Dean's outrageous bullshit about Graham being a progressive. Like Blue America, DFA has endorsed Andrew Gillum, the *actual* progressive-- the only progressive-- in the race. Yesterday, Graham's campaign sent out an endorsement e-mail ostensibly...more »

No One Is Winning The Syrian Civil War

Omar Sanadiki / Reuters *Krishnadev Calamur, The Atlantic*: *No One Is Winning the Syrian Civil War* *Bashar al-Assad is only in power because of Russia's support. His country is devastated.* Seven years ago, when Syrian protesters called for “a day of rage” against Bashar al-Assad, there were few signs that they would have an impact. Three years later, as the protests transformed into a civil war, one that would eventually draw in the region’s powers, it seemed a matter of when, not if, Assad would go the way of his fellow strongmen in Tunisia and Egypt. But on March 15, 2018, wh... more »

More countries are reporting their January 2018 inflation rate and it is becoming clearer that majority of them have reigned in the inflationary pressure of the big rise in world oil prices. West Texas Instrument (WTI) prices, for instance, rose from $43.2/barrel in 2016 to $50.9/barrel in 2017, and $63.7/barrel in January 2018. *Task and Purpose, Rich Creed* *Security, North America* Something we bet you did not know. Having spent a lot of time on tanks, I would argue that pursuing technical solutions that don’t account for the human dimension of sustained ground combat is a mistake. The four-soldier crew gives flexibility that three cannot. Pulling local security is a real requirement inside a tactical assembly area. Doing so while maintaining weapons, conducting maintenance, eating, and getting some sleep is already tough. When in radio listening silence you need a runner, and during tactical road m... more »

MY THEORY ABOUT TRUMP AND HIS FAVORITE TV STARS DIDN'T HOLD UP

Last weekend I read about President Trump's dinner with Fox News commentators Jesse Waters and Sebastian Gorka, and I also read that he was planning to make a lot of personnel changes -- but it didn't seem as if he was planning to raid Fox News to fill the vacancies he intended to create. I had a theory about that: The reason Trump doesn't just hire Fox pundits for the White House is that he thinks of Fox as *the outside world.* He doesn't see it as a sycophantic media operation that's essentially a part of the GOP -- he sees it as *America.* It's the voice of the people.
